Detailed Rules on the Implementation of Suzhou's Policies on Adjusting the Settlement of Talents
In accordance with the Notice of the Municipal People's Government on Adjusting Policies Related to the Settlement of Talents (hereinafter referred to as the Notice), the Operating Rules are hereby formulated to regulate the application, acceptance and review of the settlement of talents in our city.
1、 Scope and Object of Service
(1) Individuals who meet the provisions of Article 1 of the Notice and are willing to settle down in the administrative area of Suzhou (hereinafter referred to as "individuals");
(2) An employing unit (hereinafter referred to as "the applicant ") that applies for the settlement of its employees on duty in accordance with Articles 2 and 3 of the Notice.
2、 Basic Conditions for Applying for Settlement
(1) About individuals applying for settlement
Comply with Article 1 of the Notice;
Obtaining various educational qualifications, degrees or professional and technical titles according to law;
Those who have not gone through retirement procedures according to law.
(2) Employing Units applying for settlement
It is established in accordance with the law within the scope of Suzhou city and carries out normal production and business activities;
Standardize the establishment of labor employment system, sign labor contracts according to law, and participate in social insurance according to regulations;
The employees to be settled in meet the provisions of Article 2 and 3 of the Notice;
The employees to be settled have obtained various academic qualifications, degrees or professional and technical titles, national vocational qualifications (vocational skill level) according to law.
The applicants applying for settlement with national vocational qualification (vocational skill level), the occupation (type of work) registered in the national vocational qualification certificate (vocational skill grade certificate) held by the employees to be settled shall be consistent with the items listed in the "Suzhou High-skilled Talents Shortage Occupation (type of work) Catalog" published by Suzhou City and within the implementation period.
3、 Application Process
According to the requirements of the Notice, the settlement process shall be implemented in six steps: preliminary examination, publicity, material submission, application acceptance, review and registered residence transfer.
(1) Preliminary Examination
In principle, the preliminary examination shall be conducted through online application. The individuals or applicants applying for settlement shall log in to the online business information platform of the public employment and talent service institution in the place where the proposed settlement or unit is located, fill in and submit the pre application information and materials one by one according to the prompts and requirements of the platform. In principle, the relevant public employment and talent service institutions shall feed back the pre examination results within 3 working days from the date of receiving the pre application materials. If the application materials meet the requirements, a letter of access to archives shall be issued, and the implementation of publicity procedures shall be notified. Explain the reasons for nonconformity or request to supplement and correct materials. Those suspected of violating laws and regulations can be transferred to relevant departments for investigation and handling.
The municipal professional and technical personnel management service and vocational skill appraisal departments at all levels are responsible for the preliminary examination of professional and technical titles and national vocational qualification (vocational skill level) materials. After receiving relevant materials, all public employment and talent service institutions shall transmit them to the local professional and technical personnel management service or vocational skill appraisal department for preliminary examination.
(2) Publicity
The application for settlement shall be subject to the publicity system. Publicity forms include social publicity and internal publicity of applicants.
Social publicity. After preliminary examination, if the application materials meet the requirements, the public employment and talent service institutions at all levels shall publicize them through the website of the human resources and social security department and accept public supervision. The publicity period shall not be less than 5 working days.
Applicant publicity. The applicant shall publicize on the unit bulletin board or internal information system from the date of receiving the notification. The publicity period shall not be less than 5 working days, and truthfully feedback the publicity results to the acceptance institution.
If there is no objection to the publicity, the applicant or individual shall formally submit the application after the materials are complete. In case of any objection to the publicity, the informer may report it by letter or email published by the accepting institution during the publicity period. The accepting institution shall organize investigation and verification with relevant departments within 30 working days from the date of receiving the report materials.
(3) Material Submission
According to the requirements of the Notice, the individuals and the applicant shall submit the following materials respectively:
Materials on individual application for settlement
(1) Suzhou Talent Settlement Application Form;
(2) Educational background, degree or professional title materials;
(3) Personnel files;
(4) Registered residence and marital status materials;
(5) Integrity commitment materials.
Materials on application for settlement
(1) Suzhou Talent Settlement Application Form;
(2) Education background, degree or professional technical title, national vocational qualification (vocational skill level) materials;
(3) Personnel files;
(4) Registered residence and marital status materials;
(5) Integrity commitment and publicity feedback materials;
(6) Social insurance information.
Notes on relevant application materials
(1) Education background and degree materials
Individuals applying according to Paragraph 2 of Article 1 of the Notice shall submit education background and degree materials at the same time.
(2) Registered residence and marital status materials
① For those who intend to settle in their own property, they need to submit their resident ID card, residence register or relationship certificate, and the ownership certificate of the house they purchased;
② Those who intend to settle in the collective household of the unit shall submit their own resident ID card, resident register and the home page of the collective household of the applicant;
③ Those who plan to settle in a collective talent household need to submit their own resident identity card and residence booklet;
④ For those who intend to go and seek refuge with immediate family members, they shall submit their resident identity cards, household registration books, the statement of consent of to move in of the immediate family members and the owner of the legally stable residence, the proof of the relationship between the two parties, and the proof of the legally stable residence;
⑤ Marriage status materials. Married persons need to submit marriage certificates, divorced persons need to submit divorce certificates (with agreement) or court judgments, court mediation documents, etc; The minor children shall submit the birth medical certificate when they move; For children born out of wedlock or divorced, the direct caregiver shall submit the child custody agreement notarized by the notary office or the divorce agreement or court judgment, court mediation, etc. filed by the civil affairs department; For children of unemployed unmarried move with them, a written commitment of unemployed and unmarried shall be submitted;
⑥ The relationship certificate referred to in this article includes registered residence archives, household register, marriage certificate, birth medical certificate, paternity test certificate, relationship notarial certificate issued by the notary department, etc;
⑦ For the purposes of this Article, the term "immediate family members" refers to their spouses, parents, children, grandparents, maternal grandparents, grandchildren and maternal children.
(4) Application Acceptance
Individuals or applicants can formally submit applications after finishing the collection of application materials.
About individual application. The individuals shall submit the application materials in person to the public employment and talent service institution in the city where he/she legally and stably resides or intends to settle down. The place of residence shall be determined according to the order of legally stable residence, joining immediate family members and talent collective households.
The objects that meet the provisions of Paragraph 2 of Article 2 of the Notice may be handled with reference to the provisions of the preceding paragraph.
About applicant application. The applicant shall submit application materials to the public employment and talent service institution where the registration place is located, and determine the place of residence in accordance with the order of legally stable residence, joining immediate family members, unit collective households, and talent collective households.
In any of the following circumstances, the application shall not be accepted:
(1) The application materials are incomplete;
(2) Failing to carry out internal publicity of the unit as required;
(3) The applicant is included in the list of abnormal business operations by the market
(4) Those suspected of violating laws and regulations are transferred to relevant departments for investigation.
The accepting institution shall decide whether to accept the application within 3 working days after receiving the application materials. Those who meet the settlement conditions and have complete application materials shall be accepted and entered into the review process. For those who do not meet the conditions for settlement, the reason for rejection shall be informed. If the application materials are incomplete, the materials that need to be supplemented and corrected shall be informed at one time.
(5) Review
If the materials are complete, the acceptance institution shall organize the review and approval within 5 working days from the date of acceptance. After preliminary examination and recheck, if it meets the settlement conditions, it shall sign and issue the Suzhou Talent Settlement Registration Form with the consent of the person in charge of the accepting institution, and transmit it to the public security organ of the proposed location.
The applicant or individual shall not pass the examination if:
The applicant fails to establish labor relations according to law and fails to pay social insurance as required;
In accordance with Article 3 of the Notice, the social insurance premiums have not been paid in the first 6 months of the application, have not been paid, have been paid in arrears, have not been paid continuously, or have not been paid by the applicant;
Providing false application materials or application information inconsistent with personnel files.
If the examination is not passed, the accepting institution shall timely feed back information to the applicant or individual and explain the reasons.
(6) Registered Residence Transfer
After receiving the Registration Form of Suzhou Talents, the public security organization shall verify the identity information of individuals and relocation personnel through the National Population Information Query System within 2 working days. For the provincial household registration migration, the applicants who meet the requirements of the Jiangsu Province Inter city Household Registration Migration Business Collaborative Service Management System can fill in the Electronic Migration Permit Application Form to handle one-stop migration. After receiving the information of the migration certificate from the public security organ at the place of immigration, the public security organization at the place of immigration shall handle the migration of household registration within 3 working days. For an applicant who meets the conditions for handling a household registration transfer outside Jiangsu Province, the public security organization shall issue a Certificate of Admission on the spot or by mail according to his/her wishes, and the applicant shall go to the original place of registered residence to handle the household registration transfer procedures. The public security organ shall handle the Registration Form of Suzhou Talents after receiving it, and the handling period shall not exceed 20 working days.
The applicant shall carry the registered residence registration and marital status materials (for the transfer of a household registration outside the province, it is also necessary to carry the "Certificate of Admission" and "Household Registration Transfer Certificate"), and go to the public security organ in time to go through the formalities of settlement in accordance with the notice of the public security organ and the corresponding requirements of paragraph (3) of Article 3 of these Rules.
4、 Supervision and Management
(1) Human resources and social security departments and public security organizations at all levels should strengthen the supervision and management of the implementation of the talent settlement policy, regularly carry out data analysis and comparison, timely find problems, and urge rectification. It is necessary to strengthen the supervision and guidance of acceptance agencies at all levels on the application, acceptance, review and settlement of talents, timely carry out the review of approval files, and constantly improve the service quality.
(2) Public employment and talent service institutions at all levels shall be responsible for the specific business handling of talent settlement within their jurisdictions, establish and improve the talent settlement audit system, and implement the audit responsibility. It is necessary to formulate and improve the handling guidelines, make clear the application materials, and establish electronic documents for relevant application forms for applicants and units to download and fill in.
(3) All application units shall actively create conditions to set up unit collective households, and the public security organization shall provide convenience for the application units to set up unit collective households and smooth settlement channels. Those who have no conditions to set up unit collective households can settle in public employment and talent service institutions. The applicant unit shall take the initiative to establish a file custody relationship with the public employment and talent service institutions in the place of registration, and actively cooperate with the public employment and talent service institutions to do a good job in the management of the immigration, emigration and personnel changes of collective talent households. For applicants who neglect management, public employment and talent service institutions can suspend or cancel the migration procedures of talent collective households.
(4)The term "legal and stable residence" as mentioned in these Rules refers to the residential houses that belong to the ownership of their own houses; A house rented by a lessee with a public housing lease certificate; Public rental housing rented by low-income housing families in urban areas. The legal and stable residence does not include the common property house (except the common property security house, the spouse and minor children's common property house) and non-residential housing.
(5) The Detailed Rules shall be implemented simultaneously with the Notice. If the documents previously issued are inconsistent with the Detailed Rules, the Detailed Rules shall prevail.
